Terms and Conditions
Access to and use of this site and the products and search services available through this site (collectively, the “Services”) are subject to the following terms, conditions and notices. By using the Services, you are agreeing to all of these terms, conditions and notices, without modification. Furthermore, you acknowledge that the Terms may be updated from time to time. This site also contains links to other Web sites, Web pages and services, which are not operated by Anns Schoolwear. Your use of such Linked Sites will be subject to the terms of service contained within each such site and the respective terms of service will control the use of the respective site.
You recognise that Anns Schoolwear has no control over such Linked Sites and information, and you accept that Anns Schoolwear provides no guarantee as to the accuracy or reliability of such sites or the information contained in them and you agree that we shall have no responsibility as to whether such links locate unintended or objectionable content or otherwise cause you distress, loss or damage.
These terms and conditions shall apply to all contracts entered into between Anns Schoolwear and its customers.
Title or ownership in the goods supplied by Anns Schoolwear to the customer shall not pass to the customer until such time as full payment has been made, full payment being the receipt of cleared funds in respect of the whole order relating to the goods supplied.
Anns Schoolwear points out that whether it accepts a return of goods is entirely at its own discretion excepting where the return of goods is as a result of the failure on the part of Anns Schoolwear to supply the relevant goods in accordance with the order. Goods cannot be returned if individual design or embroidery work has been affected on such goods and/or the customer has used the goods and/or itself added the design or embroidery work.
Variation of content
Anns Schoolwear shall have the right in its absolute discretion at any time and without notice to amend, remove or vary any portion of this Policy at any time. Continued use of this site following the posting of any such changes to these Terms will mean you accept those changes.
Governing Law and Jurisdiction
These terms and conditions are to be construed in accordance with the laws of England and Wales. In the event of any dispute associated with these terms and conditions, that dispute shall be subject to the exclusive jurisdiction of the English Courts.
Anns Schoolwear points out that these terms and conditions do not in any way remove, restrict, hinder or take away from the customer any of their statutory rights.
Severance
Each of the paragraphs of these Terms and Conditions operates separately. If any provision of these Terms and Conditions are found to be invalid or unenforceable by a court, it will be severed from the rest of these Terms and Conditions which shall remain unaffected.
Third Party Rights
This contract is between you and us. A person who is not a party to this contract is not entitled to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.
Force Majeure
We shall not be liable to you for any delay in, or failure of, performance of our obligations under these Terms and Conditions arising from any cause beyond our reasonable control including, but not limited to, any of the following: act of God, governmental act, war, fire, flood, epidemic or pandemic, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to supply data or a failure in our supply chain) and industrial action.
Returns Policy
- You may return any item bought from our standard range* within 14 days of delivery providing it is in the original packaging, including labels, is suitable for resale and proof of purchase. We will only pay the return carriage costs for exchanges or refunds where the return is our error or the material is deemed to be faulty. Returns can take up to 15 working days to be processed.
- Unless incorrectly supplied or deemed to be faulty we cannot accept the return of:
- Goods that have been personalised.
- Goods that have been procured in line with your requirements.
- Goods that have been specially procured in line with your requirements and do not form part of our standard range*.
- Goods that have been worn, soiled or washed.
- This does not affect your statutory rights.
- In the unlikely event of goods arriving with production or manufacturing errors, Anns Schoolwear reserves the right to correct these prior to offering a refund, at the sole discretion of Anns Schoolwear. This may include returning faulty garments to the Manufacturer for analysis/tests.
- Sale items – Only regular priced items may be refunded. Sale items cannot be refunded.
* Our standard range is any item available on our website and does not include any special colours, sizes, design or personalisation.
